How to File for Bankruptcy

To begin the bankruptcy process, you must first find out what bankruptcy chapter you are eligible to file by taking the means test. This will determine if you can file for Chapter 7 or Chapter 13.

Chapter 7: also known as liquidation bankruptcy, this type of bankruptcy will allow for a quick discharge of debt after all non-exempt assets are sold to repay your creditors.

Chapter 13: also known as reorganization bankruptcy, this type of bankruptcy will allow you to keep all of your assets and property while gradually repaying your debts over the course of 3-5 years.

If you are trying to file bankruptcy for your business, then you will most likely use Chapter 11.

After you have determined what chapter to file, then you will need to compile all financial documents and fill out the court forms for bankruptcy. You will then file with your local bankruptcy court. Once you have filed, an automatic stay is put on your accounts, so that creditors cannot take any action against you, including:

After your debt is discharged, you can begin to rebuild your credit and get a fresh start!

Our firm has a reputation for excellence.
