We may be able to challenge the results of the Intox 5000 breath test which was administered at the police station if the machine was not properly maintained or the test was not properly performed.

A DUI arrest in Georgia starts two processes—a criminal proceeding on the citation and an administrative procedure that could result in the loss of your driver’s license. You must request an administrative hearing within ten days of your arrest. If possible, you should have the same lawyer represent you in both proceedings.

Daniel W. Mitnick & Associates, PC can use the administrative hearing to get the arresting officer to commit to certain facts which we may be able to use in your defense. We can also seek a provisional permit that can allow you to drive for work and other situations.
