Modifications in Support, Visitation, and Custody
When Georgia divorce agreements need altering
At the time a divorce is finalized, the court issues orders regarding child support, custody, and visitation arrangements. In some cases, it may mandate the payment of alimony.
Those orders have the power of law and disobeying any order can result in an enforcement action against the offending party. But support, custody, and visitation orders can be changed when the underlying circumstances of the parties change significantly.
As an experienced family law firm, the attorneys of Daniel W. Mitnick & Associates, PC have represented numerous clients in the Atlanta area and throughout North Georgia in modification matters, including—
- Modifications in child support
- Modifications in alimony
- Modifications in child custody and visitation
- Parental relocations
Child support modifications
When the income of a parent changes to a significant degree, either because of a layoff, job promotion or other reason, the court can issue a child support modification. Daniel W. Mitnick & Associates, PC represents both receivers and payers of child support in modification actions. In most cases, we can obtain a modification, either up or down, in a timely and cost-effective manner.
In January 2007, Georgia child support law changed. In most circumstances, it is now based on the incomes of both parents and custody. However, you cannot seek a modification of an existing child support order just because of this new law—you can do so only if your income or that of your spouse has changed to a significant degree.
Child custody and visitation modifications
Our lawyers can also seek to obtain a modification in child custody or visitation orders. These matters can range from simple to complex. If a parent's job schedule has changed, for example, we can often negotiate a workable solution that enables both parents to enjoy appropriate time with the child.
However, when one parent seeks to move away, or when one parent's lifestyle or behavior is alleged to harm the child, then a contentious child custody dispute can arise. Daniel W. Mitnick & Associates, PC are assertive advocates for our clients. When necessary, we go to court to protect your rights and the best interest of your child.
