Chapter 7 bankruptcy
Chapter 7 bankruptcy is the most common form of bankruptcy protection. However, it can be complex based on who is entitled to what, when, where and how.
Chapter 13 bankruptcy
A chapter 13 bankruptcy is also called a "wage earner's plan." It enables individuals with regular income to develop a plan to repay all or part of their debts according to state law.
Chapter 13 offers individuals advantages over the total liquidation alternatives in Chapter 7, including in the plan a path that enables them to save a home from foreclosure. Other advantages include—
- Rescheduling of secured debts other than the mortgage on a primary residence
- A provision that protects third parties who are liable with the debtor on "consumer debts," including co-signers
- Plan administration by a trustee who distributes payments to creditors leaving debtors with no direct contact with creditors while under Chapter 13 protection
